Attorney Marshall Lehman of Safford, AZ; ethical leprechaun The state of Arizona presented Marshall A. Lehman with a law license in 1969 after he graduated from University of Arizona Law School.
The Arizona State Bar found Marshall guilty of the following misconduct.
In one matter, Marshall found it acceptable to draft a testamentary trust that named himself as trustee. He was also on of the 19 beneficiaries to the trust. Marshall acted as trustee and attorney for the trust for 10 months, and had a fiduciary duty to the trust and to the beneficiaries.
Making matters worse, Marshall failed to timely disclose his own dealings with the trust to the beneficiaries, which are as follows:
Marshall then refused to allow a beneficiary to examine a portion of the trust records on the sham basis that the records were his personal legal product, even though he knew the work product rule had no lawful application to the trust account.
As a consequence of his misconduct, the cheerleaders of Attorney Misfits sitting on the Arizona Supreme Court punished Marshall by gifting him with a complimentary censure.
As we speak (ca. June 2013) Marshall practices at 408 Main Street in Safford, Arizona.
