Judge Stephen Yarbrough of Toledo; Il Duce Wannabee, ethically indengent

FYI: Il Duce is none other than the late Italian dictator Benito Mussolini.

In the early 2000s, Chief Justice Thomas Moyer appointed Judge Stephen Yarbrough to a case then pending in the Knox County Court of Common Pleas that involved a Mr. Szerlip.

The Szerlip case involved a family court case. During a hearing held before Judge Stephen Yarbrough, he specifically advised Mr. Szerlip that he was finding him in contempt of court. Judge Stephen Yarbrough went on to sentence Mr. Szerlip to 30-days in jail.

Mr. Szerlip then asked Judge Stephen Yarbrough why he was finding him and contempt and sentencing him to 30-days in jail.

Unbelievably, Judge Stephen Yarbrough responded by telling Mr. Szerlip that he didn’t know why he was so acting, but that he’d figure it out later. At this time, Judge Stephen Yarbrough told the bailiff, “Take him away.!”

Now folks, even the despot Il Duce would have at least advised you of the specific reasons why he found you in contempt and was sending you to jail, right?

But of course, Il Duce was much more compassionate and intelligent that Judge Stephen Yarbrough.

Subsequently, the Court of Appeals reversed the illegal contempt findings and jailing of Mr. Szerlip by Judge Stephen Yarbrough. However, this did not ameliorate the fact that Judge Stephen Yarbrough acted illegally in incarcerating Mr. Szerlip.

And how did Chief Justice Thomas Moyer react when he was made aware of Judge Stephen Yarbrough’s egregious misconduct? Chief Justice Thomas Moyer punished Judge Stephen Yarbrough by appointing him to even more cases, thereby allowing him to become the highest paid jurist in Ohio.

Who sez crime doesn’t pay? It damn sure wasn’t Judge Stephen Yarbrough and/or Chief Justice Thomas Moyer.
