Attorney Kathleen Kirt of Fairview, TN; ethical leprechaun

 
The state of Tennessee provided Kathleen M. Kirt with a law license in 1992 after she graduated from Cleveland-Marshall Law School.
 
The Tennessee Board of Professional Responsibility found Kathleen guilty of the following misconduct.
  • Failed to provide competent representation (Dumbo)
  • Failed to act with due diligence (slacker)
  • Failed to communicate with client
In one matter, Kathleen the Dumbo allowed the statute of limitations to expire on a client’s worker’s compensation claim despite being notified on at least three (3) occasions of offers to settle the case. Kathleen failed to respond to all three (3) of the settlement offers on her client’s behalf.
 
In addition, Kathleen never advised her client that the statute of limitations on his claim had expired for nearly one year even though the insurer had sent her several letters telling her the statute of limitations had expired and that the insurer was withdrawing all offers to settle the matter.
 
As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Tennessee Supreme Court punished Kathleen by gifting her with a complimentary censure.
 
As we speak (ca. May) Kathleen practices at 7215 Knottingham Drive in Fairview, Tennessee.
