Judge Joseph Temperato of Avon, NY: Dumbo

 
Joseph was successful in duping the voters into electing him as a Justice of the Avon Village Court in Livingston, New York in 2006.
 
The New York Judicial Commission found Justice Tempera guilty of the following misconduct.
 
One month after Joe was warned for improperly issuing an eviction warrant against a tenant by the Judicial Commission, he engaged in the same conduct.
 
In one matter, Joe issued an eviction warrant and rendered a $1,040 judgment against Luci Rinaldi in early 2012. Joe did so, even though a notice of petition in the case was signed not by a judge, court clerk or attorney, as required by state law, by an agent of Rinaldi’s landlord.
 
A notice of petition alerts a tenant to eviction proceedings being filed against the, and includes the amount allegedly owed to the landlord and the time and place of an eviction hearing. Section 731 of the New York Real Property Actions and Proceedings Law required that a landlord or their agent must file a notice of petition in order to bring eviction proceedings against tenants. The notice must be signed by a judge, court clerk or attorney to be valid.
 
It is obvious that Joey the Dumbo is unaware of what the term “due process” actually means. Apparently, Joey believes that the term “due process” is the means by which the grass becomes moist in the a.m.
 
The enablers for Judicial Misfits sitting on the Judicial Commission recommended that Joey receive a complimentary admonishment for his misconduct.
 
As we speak (ca. April 2013), Joey the Dumbo continues to sit as a justice of the Avon Village Court in Livingston County, New York.
