Attorney Kim Stinson of Regina, Saskatchewan; ethical misfit

 
The Law Society of Saskatchewan presented Victoria Kim Alan Stinson with a law license in 2000 after she graduated from the University of Saskatchewan Law School.
 
The Law Society of Saskatchewan found Kim guilty of the following misconduct
  1. Engaged in conduct unbecoming a lawyer (What’s new!)
  2. Misled (lied) to the Canada Revenue Agency
  3. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  4. The financial risk to his clients and/or others was significant
In one matter, Kim was acting as the legal advisor to a common Board of Directors of two related entities. One of the entities made an application to a Bank to increase its line of credit from $30,000 to $60,000. In support of the application the Bank received two letters written by Kim on his firm’s letterhead, which were directed to the Bank’s manager.
 
In his letter to the Bank, Kim referred to prior conversations between his client and the Bank. Kim stated he would be receiving money from the Saskatchewan Housing Program on behalf of his client. Kim went on to state, “I am happy to offer my undertaking to the Bank that all funds accruing due to my client will be paid to the Bank to cover all or any amount of overdrafts or line of credit owed by my client. With this assurance, I understand that the Bank will increase the line of credit on my client’s behalf.”
 
Kim knowingly misled the Canada Revenue Agency by providing them with an undertaking that he was not in a position to fulfill, and in so doing induced them to discontinue enforcement proceedings against his client.
 
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Law Society of Saskatchewan punished Kim by gifting him with a complimentary 60-day suspension of his law license.
 
As we speak (ca. April 2013), Kim practices at 2125 Borden Street in Regina, Saskatchewan.
