Attorney Marshall Lehman of Louisville, KY; self-dealing loser

 
The state of Arizona presented Marshall A. Lehman with a law license in 1969 after he graduated from the University of Arizona Law School.
 
The Arizona State Bar found Marshall guilty of the following misconduct.
 
In one matter, Marshall drafted a testamentary trust that named himself as trustee. Marshall was also one of the 19 beneficiaries to the trust. Marshall acted as trustee and attorney for the trust for about 10 months, and had a fiduciary duty to the trust and to the 18 beneficiaries.
 
Marshall failed to fully or timely disclose his own dealings with the trust to the beneficiaries, specifically: (a) that he had received a gift from the settler prior to her death, (b) that he had a writing from the settler forgiving him of a promissory noted owed to her for $13,500, (c) How and when he would receive payment for his services rendered to the estate as attorney and trustee, and (d) that he was investing stock of a speculative nature in a closely held corporation for which he was an officer.
 
As a consequence of his misconduct, the cheerleaders of Attorney Misfits sitting on the Arizona Supreme Court punished Marshall by gifting him with a complimentary censure.
 
As we speak (ca. April 2013) Marshall practices in the Louisville, Kentucky area.
