Attorney Jeffrey Berman of Greensboro, NC; ethical gremlin

 
The state of North Carolina presented Jeffrey S. Berman with a law license in 1988 after he graduated from the University of Toledo Law School. 
 
The Grievance Committee of the North Carolina State Bar charged Jeffrey with the following misconduct.
  • Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  • Engaged in conduct prejudicial to the administration of justice
  • Filed an action that he knew was contrary to law
  • Knowingly made a false statement of material fact to a trial court
In one matter, Jeffrey represented a client involved with the Department of Social Services (DSS) regarding the hospitalization of the client’s minor daughter. DSS did not allow the clients to take the child home with them.
 
Subsequently, Jeffrey met with the clients on several occasions. The client told Jeffrey that she was a suspect in DSS’s investigation of how the child was hurt. Jeffrey then advised the clients that he could file something with the court that would trump any action taken by DSS to take custody of the child.
 
Jeffrey then prepared an Affidavit as to the Status of a Minor Child that the client signed. At the time that Jeffrey prepared the Affidavit he was fully aware of the statutory requirements pertaining to such a filing.
 
Because Jeffrey intentionally omitted pertinent information from the Affidavit, the document was misleading and had the effect of concealing material facts from the court. But for Jeffrey’s false statement and intentional omission of material facts, the court would not have entered a custody order in favor of his clients.
 
All that’s left now is for the North Carolina Supreme Court to determine the punishment that Jeffrey will receive for his egregious misconduct.
 
As we speak (ca. March 2013) Jeffrey continues to practice in the Greensboro, North Carolina area.
