Attorney Alan Howard of Dallas; ethical leprechaun

The state of Texas presented Alan M. Howard with a law license in 1968 after he graduated from Southern Methodist University (SMU) Law School.

The District 6-1 Grievance Committee found Alan guilty of the following misconduct.

In one matter Alan was hired to defend a landlord in a lawsuit filed by one of his tenants. Three weeks later, the plaintiff filed a motion for summary judgment against Alan’s client. Alan failed to respond to the motion or appear at a court scheduled hearing on the motion. In addition, Alan never informed the client about the motion or the scheduled hearing.

Subsequently, the trial court granted the plaintiff’s motion for summary judgment. He also failed to notify his client about the dismissal of his case.

In another matter, Alan was hired to represent a client in a real estate transaction involving the client’s purchase of a foreclosed residential property. The client paid a $1,000 fee for Alan’s services and $80,000 to purchase the property.

Alan failed to safeguard the funds by putting them in a client trust account. Eventually Alan told the client that the house had been sold to another buyer. Alan then gave the client a check drawn on his operating account for $81,000. However, when the client deposited the check it bounced.

As one would suspect, this wasn’t Alan’s 1st bite at the Attorney Misfit Apple Tree. He previously received a complimentary stayed suspension from the comedians sitting on the Texas Supreme Court for engaging in a variety of misconduct.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Texas Supreme Court punished Alan by gifting him with a complimentary reprimand.

As we speak (ca. March 2013) Alan practices law at 8140 Walnut Hill Lane in Dallas, Texas.
