The state of Florida presented Jay Katz with a law license in 1989.
 
The Delaware Supreme Court found Jay guilty of the following misconduct.
  • Failed to provide competent representation (Dumbo)
  • Failed to explain matters to client to permit client to make informed decisions re: representation
  • Engaged in a blatant conflict of interest
In matter, Jay represented clients Robert Lubach in preparing loan documents for Lubach’s use as a lender in various loans to individuals, all secured by mortgages on their Delaware residential real property.
 
At about the same time, Arthur Cross and John Smith hired Jay to assist them with debt problems and provide legal advice concerning their estate planning. Jay then referred Mr. Cross to Lubach for the purpose of obtaining a loan.
 
As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Florida Supreme Court punished Jay by gifting him with a complimentary 90-day suspension of his law license.  
 
As we speak (ca. March 2013) Jay continues practices at 1300 North Market Street in Wilmington, Delaware.
