Attorney John Whalen of Lewiston, ME; ethical dwarf

 
The state of Maine presented John M. Whalen with a law license in 1971 after he graduated from the University of Maine Law School.
 
The Maine Grievance Commission found John guilty of the following misconduct.
 
In one matter, the Androscoggin County District Court ordered Hector Levasseur to appear and answer a motion for contempt. Hector’s appearance before the court resulted from a receivership order in a foreclosure action involving People’s Heritage Savings Bank v. Hector and Susan Levasseur.
 
Hector eventually hired John to represent him in the contempt matter. John later filed a petition for appointment of a conservator with the court requesting it appoint Hector as Susan’s conservator because of her dementia.
 
In the conservatorship action, John submitted to the probate court waivers of notice, which the three Levasseur children had signed. John signed all three waivers of notice attesting under oath that all three children personally had appeared before him to acknowledge that they had signed the waivers as their free act and deed.
 
In truth, none of the three children ever appeared before John when they executed the waivers, meaning he falsely notarized their signatures.
 
As a consequence of her misconduct, the Patron Saints for Attorney Misfits sitting on the grievance panel punished John by gifting him with a complimentary reprimand.
 
As we speak (March 2013) John continues to practice in the Lewiston, Maine area.
