Attorney Harvey Miller, Jr. of Toledo; lying loser
The state of Ohio presented Harvey Cecil Miller, Jr. with a law license in 1999 after he graduated from Ohio Northern University Law School, a 3rd tier school dedicated to accepting losers that couldn’t get into mainstream law schools like Ohio State University, Michigan University, University of Toledo or Case Western University in Cleveland.
The Toledo Bar Association Grievance Committee found Harvey guilty of charging a clearly excessive and/or illegal fee as set forth below.
Harvey found it acceptable to improperly take funds from a client trust account and use it to pay the expenses of one of Harvey’s personal clients.
In 2000, Harvey worked as a full-time, hourly employee at the Bugbee & Conkle, L.L.P, a law firm in Toledo. Harvey continued as a non-equity partner with the Bugbee firm until he was fired in December 2009.
Harvey was a debtor subject to a Wisconsin judgment enforced in a Toledo court with the issuance of a garnishment order that was delivered to Bugbee firm in June 2007. As a Bugbee partner, Harvey responded to the court in the “answer of a garnishee” that Bugbee did not possess, hold, or otherwise own any property of Harvey’s that might be subject to garnishment. Harvey falsely marked the answer “NO” on the firm’s behalf as to whether Harvey was employed by the firm.
A second garnishment notice arrived at the Bugbee firm two months later. It asked wether Bugbee had “money, property, or credits other than personal earnings of the Judgment Debtor [Harvey] under the Garnishee’s [Bugbee] control and in the Garnishee’s Possession.” Harvey falsely marked “NO” and signed the response as a Bugbee partner. The notice with the false forms was subsequently filed with the court.
In June 2009, Harvey and his wife filed a Chapter 13 bankruptcy in the Bankruptcy Court in Toledo. During the pendency of this case, Harvey repeatedly engaged in egregious misconduct by concealing funds he received from Bugbee after he was fired.
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Ohio Supreme Court punished Harvey by gifting him with a complimentary stayed 180-day suspension of his law license. In truth, the comedians sitting on the Ohio Supreme Court didn’t mete out any meaningful punishment to Harvey.
As we speak (ca. January 2013) Harvey is employed as in-house counsel with the Jeep Country Federal Credit Union at 7030 Spring Meadows West Drive in Holland, Ohio.
