Burton wrote a bad check (insufficient funds) for $50 to the Muscatine County Sheriff for service fees. After several failed attempts to contact Burton’s office, the Sheriff referred the matter to the Muscatine County Attorney.

Subsequently, Burton was criminally charged with theft in the 5th Degree misdemeanor. The clerk then issued a summons for Burton to appear in court on a date certain; however, he failed to appeal. His failure to appear caused the trial judge to issue a warrant for his arrest.

Several days later, Burton paid the Sheriff $60 and the arrest warrant was recalled, but no agreement was reached on the pending theft charges. Therefore, another citation was issued for Burton’s appearance in court on the theft charge, but again he failed to appear, which resulted in a second arrest warrant being issued.

One week later, Burton was arrested in Scott County, Iowa. He then pleaded guilty to the theft charge and was fined $65 plus court costs.

As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the Iowa Supreme Court Attorney Disciplinary Board punished Burton by gifting him with his 2nd complimentary reprimand.
