Attorney T.J. Hier of Baxter, IA; unethical Dufus

 

The Iowa Supreme Court Attorney Disciplinary Board found Terri Joe Baxter guilty of the following misconduct.
  1. Failed to act with due diligence (slacker)
  2. Failed to provide competent representation (Dufus)
  3. Knowingly disobeyed a court order
  4. Engaged in conduct prejudicial to the administration of justice
  5. Failed to expedite litigation
In one matter, Terri represented a mother in a private termination of parental rights case, which resulted in Terri filing a notice of appeal on the client’s behalf.
 
Subsequently, the child’s father moved to dismiss the appeal, and Terri filed an application for appointment of appellate counsel for her client. This caused a justice of the Iowa Supreme Court to deny Terri’s appointment application because the rules required it to be filed with the trial court and not the Supreme Court.
 
Despite the order from the Supreme Court, Terri failed to file a brief and appendix on her client’s behalf. The Clerk of the Court then issued a default and directed Terri if she didn’t correct the deficiencies within 15 days, he client’s appeal would be dismissed. Terri failed to correct the deficiencies, which led to the dismissal of her client’s appeal.
 
In another matter, Terri engaged in the same type of misconduct that ultimately led to the Court of Appeals dismissing her client’s appeal.
 
As one would suspect, this wasn’t Terri’s 1st bite at the Attorney Misfit Apple Tree. In 2011 Terri received a complimentary admonition for neglect of another client’s appeal case.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Iowa Supreme Court Attorney Disciplinary Board punished Terri by gifting her with complimentary reprimand.
 
As we speak (ca. January 2013), Terri practices at 102 North Main Street in Baxter, Iowa.
