Attorney Alan Harding of Presque Isle, ME; ethical dwarf

 
The state of Maine presented Alan F. Harding with a law license in 1978 after he graduated from the University of Maine Law School.
 
The Maine Grievance Commission found Alan guilty of the following misconduct.
  1. Charged an unreasonable or clearly excessive fee
  2. Failed to act with reasonable diligence (slacker)
  3. Failed to communicate with client
  4. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
  5. Engaged in conduct prejudicial to the administration of justice
  6. Engaged in conduct involving a criminal act
  7. Failed to cooperate with ethics investigators (Up Yours, said Alan!)
  8. Failed to promptly notify client of receipt of funds belonging to client
  9. Failed to take reasonable steps to protect client interests after being discharged
  10. Made a false statement of material fact or law to a third person
  11. Failed to provide executed fee agreement to client
  12. Engaged in multiple violations of the Code of Conduct
  13. Abandoned representation of client
  14. Engaged in a glaring conflict of interest
  15. Failed to return client file to client after being discharged
In one matter, Ms. Beverly Langley hired Alan to file a lawsuit against the Town of Hampden for negligence due to sewage flooding the Langley duplex. The flooding was due to the Town’s flushing of sewer lines that caused a partial blockage in the sewer lines. At the time, Langley shared the duplex with her elderly mother. Both women were devastated that they could not live in their homes due to the damage to the duplex and their personal property.
 
During the six-years that Alan represented Ms. Langley, Alan failed to provide professional services that she and her mother relied upon.
 
In a second matter, Alan was criminally charged for failing to file Maine income tax returns for six (6) consecutive years. Subsequently, Alan pleaded guilty and was sentenced to 180 days in jail.
 
As a consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the grievance panel punished Alan by gifting him with a complimentary 30-day suspension of his law license.
 
As we speak (January 2013) Alan continues to practice in the Presque Isle, Maine area.
