The state of New Jersey presented David Wayne Boyer with a law license in 1992.
The New Jersey Office of Attorney Ethics found David guilty of the following misconduct.
David was employed to represent a client in an estate matter. During his representation of the client, David engaged in an egregious conflict of interest when he rented real estate belonging to the estate to a former client in a bankruptcy matter without ever disclosing to the either client the nature of the dual representation and without seeking waivers of the conflict from the clients.
In another matter, David engaged in a business transaction with a client without fully explaining the terms of the transaction to the client, and without advising the client to seeking advice from a disinterested attorney.
In yet another matter, David misrepresented (lied) in a real estate disclosure statement for the sale of real estate the nature and extent of work performed by the contractor on the property. He also lied to ethics investigators that he had not received funds exceeding the initial loan to the purchaser of the real estate.
As one would suspect, this wasn’t David’s 1st bite at the Attorney Misfit Apple Tree. He previously received a complimentary admonishment and a suspension for engaging in a variety of misconduct.
As a consequence of his misconduct, the enablers sitting on the New Jersey Office of Attorney Ethics punished David by gifting him with a complimentary 90-day suspension of his law license.
