Attorney Timothy Bauman of Cedar Rapids; ethical dwarf

The Iowa Supreme Court Attorney Disciplinary Board found Timothy guilty of the following misconduct.

In one matter, Timothy represented Mary in regards to her deceased mother’s estate. The estates assets included 500 acres of farmland, parcels of which were bequeathed to specific beneficiaries. Due to a mistake in the will, a 20 acre parcel wasn’t bequeathed to anyone.

Mary’s brother John was named as executor of the estate. Subsequently John’s attorney filed a Petition for Declaratory Judgment and Determination of Heirship and Distribution regarding the 20 acres. Timothy then filed a motion in opposition on behalf of Mary. A hearing was later held on Timothy’s motion in opposition, which was denied by the trial court.

After the hearing, Timothy proposed a settlement to John’s attorney wherein the estate would pay Mary $350,000 in exchange for any land bequeathed to her in the will. John’s attorney rejected the offer and told Timothy he didn’t have any authority to pay Mary the $350,000 she demanded.

Subsequently, a meeting of all the heirs was scheduled to address estate matters. While discussing this meeting with John’s attorney, Timothy never disclosed to him that he intended to attend the meeting.

Timothy then attended the meeting on Mary’s behalf. John also attended the meeting. Timothy absolutely knew that John was represented by an attorney; however, with that knowledge he attended and participated in the meeting along with John when John’s attorney wasn’t present.

Apparently, Timothy’s intelligence level is such that he didn’t understand that he was prohibited from any personal dealings with anyone that was represented by an attorney unless the attorney authorized such contact.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Iowa Supreme Court Attorney Disciplinary Board punished Timothy by gifting him with complimentary reprimand.

As we speak (ca. December 2012) Timothy practices at 118 Third Avenue SE in Cedar Rapids, Iowa.
