The state of Utah presented H. Delbert Walker, Jr. with a law license in 1979.
Judge Leslie A. Lewis, 3rd District Court found H. Delbert guilty of the following misconduct.
In representing three clients in separate personal injury matters H. Delbert signed written reports and doctor’s liens with a chiropractic clinic for medical services provided to his clients; the clients also signed the medical liens. The written medical provider liens signed by the clients, required H. Delbert to make payments directly to the chiropractic clinic all sums owing for medical services rendered to his clients and to withhold such sums from any settlement or verdict as may be necessary to protect the clinic.
After settling client cases and receiving settlement funds, H. Delbert failed to deposit those funds into client trust accounts as required by the rules. After he paid himself and his clients from the settlement funds, H. Delbert did not promptly notify or reimburse the chiropractic clinic in accordance with the lien agreement he previously executed.
H. Delbert violated numerous rules in regards to accounting for funds held in client trust accounts over a period of at least five years. He also failed to keep accurate and required records on funds he received on behalf of his clients.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Utah Supreme Court punished H. Delbert by gifting him with a complimentary 30-day suspension of his law license.
As we speak (December 2012) H. Delbert practices at 8160 South Highland Drive in Sandy, Utah.
