Attorney Charles Oestreicher of Portland, ME; ethical misfit

 

The state of Maine presented William A. Fogel with a law license in 1968 after he graduated from Case Western University Law School in Cleveland.
 
The Maine Grievance Commission found Charles guilty of the following misconduct.
  1. Engaged in conduct unworthy of an attorney (What’s new?)
  2. Engaged in a conflict of interest
Bruce was hired by Nicholas Hubby, a partner at the law firm of Verrill & Dana, to represent him in his effort to purchase property off the Shore Road in Cape Neddick, Maine. Bruce was hired to advise Hubby as to the strength and validity of the right of way through the land that completely surrounded the Hubby’s anticipated purchase.
 
Subsequently, the property came up for sale when the beneficiary of the owner’s estate put the property up for sale. At that time, Charles represented the seller of the property even though he was also representing the buyers (Hubbys) at the same time. Apparently, Charles lacks the intelligence to appreciate and/or understand what the term “conflict of interest” actually means.
 
As a consequence of her misconduct, the Patron Saints for Attorney Misfits sitting on the grievance panel punished William by gifting him with a complimentary reprimand.
 
As we speak (November 2012) Charles practices with Verrill Dana, LLP in Portland, Maine.
