DA Benjamin Field of San Jose; scofflaw, moron, ethical gremlin

Benjamin Field is one of the most corrupt prosecutors in the country!
 
In Oct. 2007, the California Bar Court instituted proceedings against Benjamin Field charging him with a plethora of egregious misconduct, which is as follows:
  • Benjamin Field failed to disclose exculpatory evidence
  • Benjamin Field mislead (actually lied) to a judge
  • Benjamin Field failed to obey court orders
  • Benjamin Field repeatedly violated the laws of the United States and California
  • Benjamin Field committed acts of dishonest and made numerous false misrepresentations
In Feb. 2009, the Bar Court found Benjamin Field guilty of a multitude of corruption in the criminal cases described below.
 
1998 prosecution of Damon Auguste and Kamani Hendricks
 
In 1998, Benjamin Field prosecuted Damon Auguste and Kamani Hendricks on multiple counts of sexual assault on a 15-year old girl. Auguste was sentenced to 18 years and Hendricks to 37 years.
 
 
In prosecuting Damon Auguste, Benjamin Field failed illegally failed to disclose to his attorney exculpatory evidence of a secret interview with a witness who challenged the credibility of the 15-year old victim. When Mr. Auguste filed a writ of habeas based on the misconduct of Benjamin Field, he illegally concealed the whereabouts of a witness critical to the defense; lied to the judge and defense counsel that he was in possession of a taped interview of the witness; submitted false search warrant affidavit, and made false statements to the court in the habeas corpus matter in 2003.
 
All of the misconduct, much of which was criminal in nature, was conducted by Benjamin Field in order to conceal his misconduct prior to the 1998 trial and to assure that Mr. Auguste would remain in prison for another ten years.
 
In 2004 a Superior Court Judge granted Mr. Auguste’s habeas motion based on the egregious misconduct of Benjamin Field. In August 2004, Mr. Auguste pled guilty to felony statutory rape; however that conviction was reduced to a misdemeanor in Feb. 2005.
 
In regards to his conduct in several other criminal prosecutions, the Bar Court found Benjamin Field guilty of:
  • Concealing exculpatory evidence from the defense
  • Repeated instances of Benjamin Field committing perjury
  • Lying to judges repeatedly
It is abundantly clear that Benjamin Field didn’t really give a damn about assuring that justice was actually dispensed in the courts in San Jose. In fact, it is patently clear that Benjamin Field dedicated his career to the “total avoidance of propriety.”
 
After being admitted to the State Bar in Dec. 1993, Benjamin Field spent his entire career as an assistant District Attorney in San Jose. Knowing that he lacked the intellectual prowess to work in the private sector (no law firm would ever offer him a job), Benjamin Field embarked on a crusade to wrongfully convict defendants in order to build up a resume that he hoped would lead him to one day scamming the residents of Santa Clara County into electing him as the County District Attorney. And if they didn’t come about, I’m sure that Benjamin Field had his sights set on being appointed as a Superior Court Judge.
 
State Bar Court’s Recommendation on Punishment
 
In its Feb. 2009 report to the California Supreme Court, the Bar recommended that Benjamin Field’s law license be suspended for four years.
 
Why didn’t the State Bar and/or any public official take action to have Benjamin Field prosecuted for felony obstruction of justice and/or perjury?
 
The only punishment Benjamin Field deserves is to spend the same amount of years in prison that Mr. Auguste unjustly served due to his egregious misconduct. In this ol’ Dawg’s opinion, the only way to prevent this type of egregious prosecutorial misconduct in the future is to sentence the offender to same amount of years in prison that his victim unjustly served.
 
We now must await a decision from the California Supreme Court as to whether they concur with the State Bar Court’s recommendation.
