Attorney Van Ellender of Houma, LA; ethical misfit

 
The state of Louisiana presented Van F. Ellender with a law license in 1967.
 
The Office of Disciplinary Counsel found Van guilty of the following misconduct.
  1. Charged a clearly excessive fee
  2. Entered into an unfair transaction with a client
  3. Failed to provide client with written fee agreement as required by the rules
  4. Failed to advise client to obtain independent counsel in regards to a fee dispute
  5. Attempted to induce client to an agreement wherein disputed fee would be paid by a third party
In one matter with respect to his involvement with the Mineral Lease and Canal Use Agreement, Van’s representation was limited to writing one letter, a few telephone conversations and one office meeting.
 
The evidence proved that Van didn’t utilize and particular expertise nor did he invest any substantial amount of time in the matter. The Committee ruled that Van’s preparation of an open-ended Contingent Fee Agreement calling for a fee of $5,000 per year was clearly excessive.
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Louisiana Supreme Court punished Van by gifting him with a complimentary 12-month suspension of his law license.
 
As we speak (ca) November 2012) Van practices at 704 Winfield Blvd. in Houma, Louisiana.
