The state of New York provided Kevin James Gilvary with a law license in
The 10th Judicial District found Kevin guilty of the following misconduct.
Kevin was appointed in 2007 to represent Maria Murray in a hearing to determine whether Maria was incapacitated, The Suffolk County Supreme Court then appointed attorney Marina Martielli to serve as Maria’s guardian up until Marina filed a mot ion to be relieved of her duties.
After Martielli was relieved as guardian, the court appointed Kevin as interim guardian for Maria. However, because Kevin neglected to file a $300,000 bond with the court, he was unable to access the guardian bank account that Ms. Martielli had opened for Maria.
Subsequently, Maria’s caretaker threatened to quit unless she was paid. Since Kevin wasn’t authorized to sign checks from the guardian account, he went ahead and forged Ms. Martielli’s name in order to keep the caretaker from walking off the job. Kevin then forged several more checks payable to the caretaker, and in one case he signed a check made out to cash to reimburse himself for payments he claims he made to the caretaker. Shortly thereafter, Kevin was relieved of his guardianship duties.
Because Attorney Misfits are held to a lower standard of conduct then everyone else, Kevin was never criminally charged for forgery.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Appellate Division, Second Department punished Kevin by gifting him with a complimentary censure.
As we speak (ca. November 2012) Kevin practices at 147 West Montauk Highway in Hampton Bays, New York, which is on the tip of Long Island.
