Attorney Cary N. Statfield of Carmel, IN;  ethical gnome

 
The state of Indiana provided Cary N. Statfield with a law license in 1979.
 
The Indiana Disciplinary Commission found Cary guilty of the following misconduct. 
  1. Failed to act with reasonable diligence and promptness (slacker)
  2. Failed to keep client reasonably informed about stats of legal matters
  3. Failed to explain matters to client to extent necessary to permit client to make informed decisions regard his representation
In one matter, an out-of-state law firm hired Cary to represent its client in setting aside a default judgment taken in an Indiana court. Cary received all of the necessary paperwork and a retainer of $1,000 from the law firm.
 
Cary failed to file a motion to set aside the judgment for nearly one year. During this time he failed to respond to the law firm’s telephone calls, emails and faxes requesting a stats report on the matter.
 
18 months after he was originally hired, Car finally reported to the law firm that the court denied his untimely motion to set aside the judgment. Cary then advised the law firm that additional funds would be needed for a filing fee to initiate an independent action to set aside the judgment. Cary received the additional funds, but did not promptly file the independent action. Over the next four months, Cary again refused to respond to status inquires from the law firm. At the time the law filed a ethics complaint against Cary he still hadn’t filed the independent action.
 
As a consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Indiana Supreme Court punished Cary by gifting him with a complimentary reprimand.
 
As we speak (ca. October 2012) Cary practices at 775 Bennett Court in Carmel, Indiana.
