Attorney Mark Kierstead of Waterville, ME; unethical Dumbo

 
The state of Maine presented Mark S. Kierstead with a law license in 1972 after he graduated from Yale University Law School in Cleveland.
 
The Maine Grievance Commission found Mark guilty of the following misconduct.
  1. Conduct unworthy of an attorney (wink, wink)
  2. Conduct involving dishonesty
  3. Engaged in conduct prejudicial to the administration of justice
  4. Charging excessive fees (cheater)
  5. Improper withdrawal from representation
  6. Failure to employ reasonable care and skill (moron)
  7. Failed to maintain proper and complete records of client funds
  8. Failed to promptly deliver client funds to client
  9. Communicated with adverse party that was represented by counsel
  10. Employed legal process for delay, harassment or malicious injury
  11. Failed to attend to the simplest of undertakings
  12. Neglected his obligation to pay promised fee to attorney
  13. Failed to respond to client requests for assistance to resolve conflict w/prior attorney
In one matter, Mark represented Laura Pelletier in a personal injury case. Laura hired Mark after becoming dissatisfied with the Leen & Emery law firm. The Leen firm advised Mark in writing that its fee agreement with Laura required that she pay them 30% of any funds she received on her personal injury claim. The Leen firm then entered into an agreement with Mark to accept $3,000 from any settlement of Laura’s claim.
 
Subsequently, Mark settled Laura’s claim for $32,500, but he failed to pay the Leen firm the $3,000 he promised. This led the Leen firm to file a lawsuit against Laura and Mark. Mark’s gross negligence and refusal to pay the Leen firm the $3,000 he promised, led to Laura incurring unnecessary additional expenses along with considerable anxiety.
 
As a consequence of her misconduct, the Patron Saints for Attorney Misfits sitting on the grievance panel punished Mark by gifting him with a complimentary reprimand.
 
As we speak (October 2012) Mark practices with Ferris Gurney & Crook at 11 Park Street in Waterville, Maine.
