Attorney Carol Gilbert of Weston, MA; ethical misfit

The state of Massachusetts presented Carol A. Gilbert with a law license in 1987.

The Massachusetts Board of Bar Overseers found Carol guilty of the following misconduct.
  1. Engaged in conduct prejudicial to the administration of justice
  2. Knowingly violated the legal rights of others
  3. Engaged in conduct adversely reflecting on her fitness to practice law
  4. Engaged in conduct involving fraud, deceit, dishonesty or misrepresentation
Carol worked as a bar advocate in juvenile court. As a bar advocate representing juveniles, she was authorized to request and obtain criminal offender information for persons involved in her cases. However, Carol was not authorized to obtain criminal records about any person who not involved in a proceeding in which was representing a party or serving as a court appointed guardian ad litem.

At one time, Carol was involved as a party in litigation in probate and family court brought by the father of her minor child concerning visitation and other rights involving the child. Subsequently, the court appointed a guardian ad litem to investigate and report on the contested issues in the case.

Carol intentionally violated the law when she requested the criminal records of the father of her minor child. She also received the records of the father’s 19-year-old son. She then submitted the criminal records to the guardian ad litem in order to limit the father’s access to the minor child.

Because Attorney Misfits in Massachusetts are held to a much lower standard of conduct then everyone else, Carol was never criminally charged for her conduct.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Board of Bar Overseers punished Carol by gifting her with a complimentary reprimand.

As we speak (ca. October 2012) Carol practices at 37 School Street in Weston, Massachusetts.
