Attorney Michael Callahan of Abington, MA;  ethical dwarf

The Massachusetts Supreme Court presented Michael S. Callahan with a law license in 1978.

The Board of Bar Overseers found Michael guilty of the following misconduct.
  1. Failed to communicate with client
  2. Failed to advise client of status of legal matter
  3. Abandoned client on morning of trial
  4. Failed to provide client with accounting of fees paid to him
  5. Failed to promptly return unearned fees (cheater)
  6. Conduct caused harm to client
In on matter, Michael was hired to represent a client in a custody case in the probate court. The client paid Michael a $2,500 retainer against which he was to bill hourly for services rendered.

On several consecutive occasions, Michael obtained continuances of trial dates concerning custody based on his alleged medical problems. After the fourth or fifth continuance, the trial court ordered that there would be no further continuances and instructed Michael to tell his client to make arrangements for substitute counsel in the event Michael didn’t appear at the trial.

On the morning of the trial, Michael did not appear. This was the first time the client was aware that the judge ordered Michael to tell the client to arrange for another attorney to appear at the trial in the event that Michael didn’t show up.

The client then fired Michael and requested an account and return of his retainer. Michael did not reply, which led the client to file a complaint with bar counsel. After bar counsel began an investigation, Michael refunded the retainer.

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the Board of Overseers punished Michael by gifting him with a complimentary reprimand.

As we speak (ca. October 2012) Michael continues to practice in the Abington, Massachusetts area.
