Attorney Heather O’Farrell of Westfield, IN; greedy loser

 
The state of Indiana provided Heather McClure O’Farrell with a law license in 1995.
 
The Indiana Disciplinary Commission found Heather guilty of the following misconduct. 
  • Charging unreasonable fees (cheater)
  • Failed to return unearned fees
In one matter, a client hired Heather to prepare and file for dissolution of her marriage, to represent her in the preliminary hearing in the case, and to obtain a protective order against the client’s husband. Heather charged the client a $3,000 engagement fee for the cases, plus $131 for filing fees, which the client paid by credit card. Heather had the client sing a fee agreement that contained the following provisions:
  1. "The engagement fee is non-refundable and shall be deemed earned upon commencement of Attorney’s work on the case.”
  2. “Attorneys agree to credit any engagement fee received from Client toward the flat fee . . . . Said engagement fee shall be due and owing at the time of execution of this contract. Client agrees to make no demand for a refund or return of any part of the engagement fee owed or paid.”
  3. “In the event that the Client-Attorney relationship terminates prior to the completion of Attorneys’ representation as described . . . above, Client and Attorneys agree Attorneys shall, at the Attorneys’ sole discretion, be entitled to keep the engagement fee paid.”
As you can see Heather’s BS fee agreement is basically a license to steal. However, such an agreement is not enforceable in Indiana, a fact well known to Heather the Loser. And this wasn’t the only example of Heather attempting to stick it to clients by attempting to retain a fee that was never earned. With Heather, it was almost like Attorney Unemployment Compensation!
 
As a consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Indiana Supreme Court punished Heather by gifting her with a complimentary reprimand.
 
As we speak (ca. October 2012) Heather continues to practice in the Westfield, Indiana area.
