Attorney Daniel Simcoe of Grants Pass, OR; ethical misfit

The state of Oregon provided Daniel Simcoe with a law license in 1980.

The Oregon State Bar found Daniel guilty of the following misconduct.

Daniel represented the owner of a dance studio. Daniel’s son took lessons from the client’s studio in exchange for providing legal services to the client. Subsequently, a dispute arose between the client and a choreographer who worked for the client. Later on the choreographer was fired and threatened to set up a competing business.

Daniel’s client then became concerned about competition and drafted contracts to be signed by her student dance teachers that included non-competition clauses. The father of one of the student teachers was concerned about the implications of the non-competition clause and called Daniel to ask whether the clause was legal.

The father advised Daniel that he had told his daughter she should not sign the contract. Daniel then advised the father that any contract signed by a minor can be declared void. Because Daniel represented the owner of the dance studio, he was prohibited from giving advise to the father since it constituted a conflict of interest. Apparently Danny the Dufus was unable to appreciate what the meaning of a “conflict of interest entailed!

As a consequence of his misconduct, the enablers for Attorney Misfits at the Oregon State Bar punished Daniel by gifting him with a complimentary reprimand. Another reprimand in 2000

As we speak (ca. September 2012) Daniel practices at 242 Northwest E Street in Grants Pass, Oregon, which is about 30 miles northwest of Medford.

On his website at www.danielsimcoe.com, Danny doesn’t make any mention that he was previously disciplined for engaging in the misconduct aforementioned.
