Attorney Donald Eisenberg of Madison, WI; serial thief

The state of Wisconsin presented Donald S. Eisenberg with a law license in 1956 after he graduated from the University of Wisconsin Law School.

The Office of Lawyer Registration (OLR) found Donald guilty of the following misconduct that led to his license being revoked in 1989.
  1. Repeatedly wrote checks on account with insufficient funds (rubber)
  2. Repeatedly misused client trust accounts
  3. Engaging in conduct involving dishonesty, fraud, deceit or misrepresentation
  4. Don admitted that he illegally borrowed money from client trust account
  5. Commingled client funds with personal funds
  6. Used funds of one client to pay the debts of another client
  7. Failed to maintain and preserve complete records of client funds
Donald thought it was cute to make payments to himself for several thousand dollars on behalf of one client from funds on deposit in a trust account belonging to other clients. Stealing from Peter to pay Paul!

In one instance, Donald drew a $20,000 check on his client trust account payable to his uncle. Don concealed the illegal transaction by marking the check stub “void” and not recording the check on the trust account ledger. Later the same month, Donald deposited $20,000 into the trust account on behalf of his uncle. This transaction also wasn’t record on the trust account ledger. Shortly thereafter, Donald made another $20,000 loan to his uncle using the same deceptive means.

During a one-year period of time, Donald with funds from his firm’s trust account for his personal use in an amount totaling $58,000. When Don withdrew these funds, he had no (zero) personal funds on deposit in the trust account.

As one would expect, this wasn’t Donald’s 1st bite at the Attorney Misfit Apple Tree. He previously received a complimentary reprimand and a 180-day suspension of his law license for engaging in a variety of misconduct.

Because Attorney Misfits in Wisconsin are held to a much lower standard of conduct then everyone else, Donald was never criminally charged with stealing money from his clients and/or for writing bad checks.
Thanks to the comedians sitting on the Wisconsin Supreme Court, they decided to reinstate Donald’s law license thereby giving him another opportunity to earn a living as a dishonest lawyer.

As we speak (ca. September 2012) Donald practices with the Eisenberg Law Offices SC at 308 East Washington Avenue in Madison, Wisconsin.
