Attorney Joseph Maffongell of Montclair, NJ; ethical misfit

 

The state of New Jersey presented Joseph Maffongell with a law license in 1969.
 
The New Jersey Office of Attorney Ethics found Howard guilty of the following misconduct.
  1. Gross neglect
  2. Lack of due diligence (slacker)
  3. Failed to keep client reasonably informed about legal matter    
  4. Failed to respond to client requests for information
  5. Violated court rules by failing to provide client with written fee agreement
  6. Failed to return file to client after being fired
  7. Failed to expedite litigation
  8. Demanded that client sign a document approving of Joe’s gross negligence/misfeasance
In one matter, Joseph continued to misrepresent the facts to a trial judge about his client and an upcoming trial. While speaking to the judge and defense counsel, Joseph never told them that his client was dead and that a trial could not be held. Apparently, Joe’s motive in not telling the truth about his dead client was to coerce a settlement from defense counsel’s client. When it was discovered that Joe’s client was dead, Joe dismissed the lawsuit.
 
As a consequence of his misconduct, the Patron Saints for Attorney Misfits sitting on the New Jersey Supreme Court punished Joseph by gifting him with a complimentary 12-month suspension of his law license.
 
As we speak (ca. August 2012) Joseph practices at 533 Bloomfield Avenue in Montclair, New Jersey.
