Attorney Joseph Cerbone of Mt. Kisco, NY; serial offender

 
The state of New York presented Joseph J. Cerbone with a law license in 1966.
 
Joe previously sat as a Judge on the Mount Kisco Town Court in Westchester County. As a part-time judge, Joseph was permitted to continue to practice law.
 
During his tenure on the bench, the Judicial Commission found Joseph guilty of misconduct on at least two occasions as set forth below.
 
Joe’s 1st bite at the Judicial/Attorney Misfit Apple Tree
  1. Made illegal ex parte call to victim in an assault case
  2. Conducted arraignments in a police station
  3. Engaged in an egregious conflict of interest
  4. Failed to withdraw from a case when he was clearly biased in favor of the defendant
In one matter, Joe forced the victim of a domestic violence to drop the charges because Joe represented the abuser and members of his family in various legal matters.
 
As a consequence of his misconduct, the apologists for Judicial Misfits sitting on the Judicial Commission punished Joseph by gifting him with a complimentary admonition.
 
Joe’s 2nd bite at the Judicial/Attorney Misfit Apple Tree
 
  1. Withdrew client funds from trust account w/o knowledge or consent of client
  2. Converted client funds to his own personal use
  3. Engaged in conduct adversely reflecting on his fitness to practice law
 
As a consequence of his misconduct, the apologists for Judicial Misfits sitting on the Judicial Commission punished Joseph by gifting him with a complimentary 12-m,onth suspension of his law license.
 
Joe’s Prior Misconduct
 
In addition to the above, Joe received another complimentary admonition and four (4) complimentary cautionary letters relating to a variety of misconduct.
 
Subsequently, the Judicial Commission ordered that Joe be permanently removed form the bench.
 
As we speak (ca. August 2012) Joseph practices at 84 Smith Avenue in Mount Kisco, New York.
