Attorney Thomas R. Mitchell of Salt Lake City; ethical leprechaun

The state of California provided Thomas Ralph Mitchell with a law license in 1998 after he graduated from the University of Utah Law School.

The California Bar Court found Thomas guilty of misconduct on several occasions.
  1. Aided another in the unauthorized practice of law
  2. Solicited or induced another to violate Rules of Professional Conduct
  3. Committed acts of moral turpitude (aka, dishonest)
For at least six months, Thomas worked as an associate in the law firm of William B. Peavey, a San Francisco lawyer who suspended at the time. Tom was paid hourly and in cash, had siging authority on the firm’s client trust account, and used the firm’s stationery to list himself as an attorney.

Tom assisted Peavey in holding himself out as being entitled to practice law with respect to at least six clients. In one matter, Peavey cashed a $17,500 settlement check by forging the client’s signature, and two other clients did not receive their settlement funds.

Tom never advised the clients that Peavey was suspended and he knowingly assisted Peavey in the unauthorized practice of law and helped Peavey collect settlement funds ant illegal fees.

As a consequence of his misconduct, the apologists for Attorney Misfits sitting on the California Bar Court punished Thomas by gifting him with a 90-day suspension of his law license. In truth,

As we speak (ca. August 2012) Thomas practices at 8316 Valiant Drive in Salt Lake City, Utah.
