Attorney Richard E. Clark of Liverpool, NY; cheating deadbeat

The state of Arizona provided Richard E. Clark with a law license in 1983 after he graduated from Albany University Law School in 1976. The State of New York presented Richard with a law license in 1976.

The Arizona State Bar found Richard guilty of the following misconduct.

When Richard filed for bankruptcy, a prior client obtained a non-dischargeable judgment against him from the bankruptcy court. In an attempt to collect on the judgment by having garnishments issued against Richard’s clients who owed him money, the former client scheduled a debtor’s exam to question Richard about the amounts owed to him for legal services rendered.

The day before the debtor’s exam of Richard was to take place, he formed a professional corporation and transferred all of his business assets thereto, thus rendering him insolvent and precluding the former client’s collection efforts.

The State Bar deemed that Richard’s engaged in conduct prejudicial to the administration of justice. In truth, Richard perpetrated a fraud on his former client as well as the bankruptcy court.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Arizona Supreme Court punished Richard by gifting him with another complimentary censure.

As we speak (ca. August 2012) Richard practices at 8212 Whitman Way in Liverpool, New York.
