Attorney Albert Potter II of Bowling Green, OH; ethical elf

 
The state of Ohio presented Albert Loron Potter II with a law license in 1982 after he graduated from the University of Toledo Law School.
 
Disciplinary Counsel of the Ohio Supreme Court found Albert guilty of the following misconduct.
  • Engaged in conduct involving deceit, dishonest, fraud or misrepresentation
  • Engaged in conduct adversely reflecting on his fitness to practice law
Albert represented an elderly client who lived in a nursing home on a legal malpractice claim. In addition, the client granted Albert a power-of-attorney to manage his financial affairs. Because the prior attorney depleted the client’s savings, leaving him no funds for his nursing-home care and medical needs.
 
After the client died, Albert was appointed executor of the estate. He determined it necessary to sell the client’s farm property to satisfy the mortgage and pay for the client’s prior care. The sole beneficiary agreed that the sale was necessary. An appraisal approved by the probate court appraised the property at $183,750.
 
Kenneth wanted to buy the farm property and to accomplish the task he asked a friend to purchase the property in his own name while using funds provided by Albert. Subsequently, Albert, as executor for the estate, entered into a contract to sell the farm property to the friend for $183,750. The cashier’s check the friend used to buy the property was drawn from Albert’s personal funds.
 
Of course Albert didn’t disclose his personal involvement in the purchase of the farm to the beneficiary of the estate, the probate court, or the closing agent.
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Ohio Supreme Court punished Albert by gifting him with a complimentary stayed 1-year suspension of his law license. In truth, the comics sitting on the Court didn’t meet out any real punishment to Albert.
