The state of New Jersey presented Philip Feintuch with a law license in 1965.
 
The New Jersey Office of Attorney Ethics found Martin guilty of the following misconduct.
 
Negligent misappropriation (stole) of client funds
Commingled client funds with his personal funds
 
Alleged Negligent Misappropriation of Client Funds
 
I’m at a loss to understand how someone could negligently or mistakenly steal client funds. With that said, the following are the facts regarding Philip’s alleged negligence after he deposited $56,161.19 of estate funds in a client trust account.
  1. Wrote a check for $10,454.34 to redeem tax certificates on property owned by Philip and his wife
  2. Wrote a check for $340.26 to pay his wife’s obligations as a realtor regarding a closing
  3. Wrote a check for $15,000 to the law firm of Feintuch, Porwich and Feintuch
  4. Wrote checks for nursing home care for his mother Ida Kanis
Philip’s Hyperbolic (BS) Defenses
 
In defense of his misconduct, Philip had the temerity to claim he was suffering from severe stress caused by the illness of his daughter and the deterioration of his mother’s health. Philip purchased the services of Dr. Robinson who opined that had Philip undergone a psychiatric evaluation, he would have been found to have met the diagnostic criteria for a major depressive episode. How can this idiot make a diagnosis based on what might have happened if Philip underwent an evaluation? What a joke!
 
Why is that that vast majority of Attorney Misfits defend their misconduct by claiming they were depressed and/or it came about because a family member was ill. This is pure BS!
 
As a consequence of his misconduct, the patron saints for Attorney Misfits sitting on the New Jersey Supreme Court punished Philip by gifting him with a complimentary 90-day suspension of his law license.
 
As we speak (ca. July 2012) Philip practices with Feintuch, Porwich & Feintuch at 721 Newark Avenue in Jersey City, New Jersey.
 
On his self-serving website at www.lawyer-jersey-city.com, Philip makes no mention of being found guilty of the misconduct aforementioned. He likely decided to forgo disclosing these facts since it would tend to limit his future victim pool.
