Attorney Joseph Pfundstein of Pepper Pike, OH; ethically deprived

 
The state of Ohio presented Joseph Anthony Pfundstein with a law license in 1991 after he graduated from Case Western University Law School in Cleveland. 
 
Disciplinary Counsel of the Ohio Supreme Court found Joseph guilty of the following misconduct.
  1. Engaged in conduct involving fraud, deceit, dishonest or misrepresentation
  2. Failed to act with reasonable diligence (slacker)
  3. Failed to keep client reasonably informed of status of legal matter
  4. Failed to respond to client’s requests for information
  5. Engaged in conduct prejudicial to the administration of justice
  6. Engaged in conduct adversely reflecting on his fitness to practice law
  7. Made false statements of fact to client
  8. Engaged in a pattern of misconduct involving multiple offenses
In one matter, Phillip Einhorn hired Joe to pursue a legal-malpractice claim. Subsequently, Joe obtained a $3,906.52 judgment against the offending lawyer. Joe then agreed to collect on the judgment, but did nothing over the next six (6) years, thereby leaving the client holding the bag.
 
Mr. Einhorn made numerous phone call and e-mail requests to Joe for the status of the collection effort, but Joe failed to respond. Furthermore, Joe falsely advised Einhorn that he had “been waiting on a court date to finish his update.” Later on, Joe again lied to Einhorn by telling him he was “waiting on the Garfield Heights Municipal Court for a date for a show cause motion that would be coming in about a month. This lie took place six (6) years after Einhorn received the court judgment for $3,906.5 2.
 
Joey also falsely told Einhorn that he “found out where the attorney works” and was “trying to garnish her wages.” This was a blatant fabrication because the attorney had been indefinitely suspended from practicing law for five years when Joey told this blatant lie. The truth of the matter was that Joe had not been involved in any litigation of any kind involving the collection of Einhorn’s judgment.
 
In another matter, Joey represented Einhorn in an employment-discrimination claim. Due to Joe’s failure to comply with court orders, he was forced to dismiss Einhorn’s lawsuit. Seven (7) years after the dismissal, Joey advised Einhorn that the lawsuit was still pending. In fact, in one e-mail Joey the Liar said, “kind of in a holding pattern, nothing really going on but should be picking up in a couple of weeks.
 
As a consequence of his 3rd bite at the Misconduct Tree, the cheerleaders for Attorney Misfits sitting on the Ohio Supreme Court punished Joseph by gifting him with a complimentary stayed 1-year suspension of his law license. In truth, the comedians sitting on the Court didn’t really provide an real punishment to Joseph.
