Attorney David Anderson of Charleston, WV; moronic slacker

 

The state of West Virginia presented David Mitchell Anderson with a law license in 2000 after he graduated from the University of West Virginia School of Law.

 

The Lawyer Disciplinary Board found Davey guilty of engaging in the following misconduct, all of which took place in matters that Davey was assigned by the state to defend indigent defendants.

  • Failed to provide competent representation (moron)
  • Failed to act with due diligence (slacker)
  • Failed to respond to client information requests
  • Failed to keep client informed of status of matter
  • Client contacted circuit court telling the presiding judge that Davey hadn’t been in contact with him for over six months
  • Failed to notify his client of court’s dismissal of a criminal charge
  • The circuit court ordered Davey on more than occasion to contact his client
  • Due to Davey’s gross negligence his client spent 433 days in custody without any pending charges, detainer, or remaining sentence being imposed
  • Engaged in conduct prejudicial to the administration of justice
  • Failed to explain matter to extent necessary to permit his client to make informed decisions regarding the representation

And lastly, do the Judges of the 13th Judicial District plan to warn indigent defendants of the fact that Davey has been found to be incompetent and that a client spent 433 days in jail due to his incompetence in the event Davey is assigned to a defendant. If not, then said judge should be disciplined for concealing this type of highly relevant information from any indigent individual appearing in his/her court.

 

 As a direct consequence of his misconduct, the apologists for Attorney Misfits sitting on the West Virginia Supreme Court punished Davey by gifting him with a complimentary 60-day suspension of his law license.

 

As we speak (ca. December 2023), Davey practices his so-called brand of law with the Public Defender Corporation for the 13th Judicial District in Charleston, West Virginia.
