Attorney Mark Svejda of Scottsdale, AZ; repeat offender

 

The state of Arizona presented Mark Svejda with a law license in 1986 after he graduated from the University of Iowa School of Law.

 

The Arizona State Bar found Mark guilty of engaging in the following misconduct.

 

Mark’s 1st bite at the Attorney Misfit Apple Tree

  • Negligently involved in preparing a will for a German citizen, Mr. Kell, while Mark was a contingent beneficiary and Mark’s wife was a beneficiary
  • After Mr. Kell died, Mark had an actual or potential conflict of interest that he failed to explain adequately to Mrs. Kell while acting as personal representative of the Kell estate
  • The conflict resulted because he also represented a company named TDI in which Mark’s wife became a 40 percent shareholder and which was the general partner in several limited partnerships in which Mr. Kell and later the estate was the limited partner while Mark was a contingent beneficiary and his wife was a beneficiary of the Kell estate
  • Mark failed to explain fully his actual or potential conflict or to obtain a conflict of interest waiver
  • Negligently failed to notify Mrs. Kell, her attorneys, or the estate’s attorney of the sale of the real estate underlying a limited partnership or the investment of the sale proceeds in a mortgage company
  • Negligently failed to initiate the dissolution of the partnership on behalf of the general partner TDI
  • Engaged in a pattern of misconduct
  • Failed to notify Mrs. Kell or her attorneys the estate’s attorney, the subsequent personal representative or his counsel, or the Probate Court about the sale of the real estate underlying an additional limited partnership
  • Knowingly failed to seek clarification of the court’s order restricting the assets
  • Negligently failed to notify individuals about the investment of the proceeds of the sale in the mortgage company
  • Negligently did not initiate the dissolution of the partnership on behalf of the general partner TDI -- all of which led to extensive litigation
  • Misconduct involved multiple offenses

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Mark by gifting him with a complimentary 6-month suspension of his law license and assessed $1,200.00 in investigative costs.

 

Mark’s 2nd bite at the Attorney Misfit Apple Tree

  • Mark accepted the transfer of his client/spouse’s sole and separate property into the marital community when he knew his client/spouse’s assets were at issue
  • Failed to fully advise his client/spouse of the potential adverse consequences and his client/spouse was subjected to an adverse ruling regarding the transfer
  • Mark improperly accepted payments from his client/spouse when he knew the funds used for payment were the subject of an interpleader motion
  • Failed fully inform his client/spouse of the potential consequences of paying him with disputed funds, and his client/spouse was subjected to a contempt motion, an evidentiary hearing, and an adverse ruling

As a direct consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arizona Supreme Court punished Mark by gifting him with a complimentary 6-month suspension of his law license and assessed $1,200.00 in investigative costs.

 

And lastly, as one would suspect, Mark fails to mention the misconduct set forth above on his self-serving website at www.azrealestatelawyers.legal. Apparently, he chose to conceal this relevant information from prospective clients for the purpose of not limiting his future victim pool.

 

As we speak (ca. December 2023), Mark practices his so-called practice of law with The Law Offices of Mark D. Svejda PC at 14300 North Northsight Blvd in Scottsdale, Arizona.
