Attorney Frank Simmons, Jr. of Toledo, OH; serial liar

 
The state of Ohio presented Frank James Simmons, Jr. with a law license in 1992 after he graduated from the University of Toledo Law School.
 
Disciplinary Counsel of the Ohio Supreme Court found Frank guilty of the following misconduct.
 
Frank’s sister Jessica Simmons is a licensed attorney in Michigan. Unlike his sister, Frank was not licensed to practice law in Michigan.
 
Frank found it acceptable to represent a client in a family court matter in Michigan. At the time, Frank was suspended from the practice of law in Ohio. In court filings in the family court matter, falsely identifying himself and his sister Jessica as the attorneys of record in the case, affiliated with Simmons & Simmons, LPA in Detroit.
 
Subsequently Frank personally appeared in the Michigan court without advising the court that he was not licensed to practice in Michigan. Frank went on to negotiate a settlement with the client’s former spouse and submitted the order for parenting time to the court for its signature. The court then discovered Frank wasn’t licensed in Michigan and refused to sign the order.
 
In another matter, Frank filed a motion for substitution of counsel and an entry of appearance on behalf of different client in a criminal matter pending in another Michigan court. Frank again falsely represented that Jessica Simmons of Simmons & Simmons was the counsel of record. He also lied that Jessica Simmons was requesting the court to permit him to act as counsel for the client in the pending matter and then signed (forged) her name to the request.
 
Because Attorney Misfits in Michigan and Ohio are held to a much lower standard of conduct then everyone else, Frank was never criminally charged for obstruction of justice.
 
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Ohio Supreme Court punished Frank by gifting him with a 6-month suspension of his law license.
 
As we speak (ca. June 2012) Frank practices law with Simmons & Simmons LLP at 4231 Dahlia Drive in Toledo, Ohio.
