Attorney Elaine Dowling of Las Vegas; cheater, serial offender

 

The state of Nevada presented Elaine A. Dowling with a law license in 2003 after she graduated from the University of Nevada School of Law.

 

The Nevada Disciplinary Board found Elaine guilty of engaging in the following misconduct.

 

Elaine’s 1st bite at the Attorney Misfit Apple Tree

  • Knowingly caused injury to her client
  • Entered into an agreement, charged, or collected an unreasonable fee (cheater)
  • Failed to take steps to protect a client’s interest upon being terminated
  • Upon receipt of a $32,500 retainer, Elaine deposited it into her office account and spent over $9,000 of the fee within 48 hours before she performed any work on the client’s behalf
  • Retained unearned fees for over a year despite numerous client requests to refund said funds

As a direct consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Nevada Supreme Court punished Elaine by gifting her with a complimentary reprimand and assessed investigative costs of $1,500.00.

 

Elaine’s 2nd bite at the Attorney Misfit Apple Tree

  • Engaged in a conflict of interest
  • Was untruthful in statements to others
  • Faield to she was not a third-party neutral when acting as an escrow agent for a transaction between her cleint and an unrepresented non-client
  • Failed to timely inform the non-client to seek independent counsel
  • Passed along incorrect information in response to the non-client’s request for assurance that Elaine’s cleint would fulfill the underlying contract
  • Knowingly violated duties owed to the public and the profession

As a direct consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Nevada Supreme Court punished Elaine by gifting her with a complimentary stayed 6-month suspension of her law license and assessed investigative costs of $2,500.00.

 

In truth, the comedians sitting on the Nevada Supreme Court didn’t mete out any meaningful punishment to Chrissy

 

Elaine’s 3rd bite at the Attorney Misfit Apple Tree

  • Failed to act with due diligence (slacker)
  • Failed to safeguard client funds
  • Assisted a disbarred attorney and suspended from practicing before the SEC in representing clients and appearing before the SEC
  • Lack of diligence led to monetary sanction being assessed against her client
  • Failed to properly manage her trust accounts
  • Commingled client funds with personal funds
  • Failed to fully cooperate with ethics investigators (Screw you, said Elaine!)
  • Failed to provide client and trust account ledgers to ethics investigators
  • Misconduct clearly harmed her client (victim)

As a direct consequence of her misconduct, the cheerleaders for Attorney Misfits sitting on the Nevada Supreme Court punished Elaine by gifting her with a complimentary 1-year suspension of her law license and assessed investigative costs of $2,500.00.

 

As we speak (ca. July 2023), Elaine practices her so-called brand of law in Las Vegas, Nevada.
