Attorney Andre Hogan of Fayetteville, NC; ethical troll

 

The state of Nevada presented Andre N. Hogan with a law license in 2005 after he graduated from the  University of Indian School of Law.

 

The Grievance Committee of the North Carolina State Bar found Andre guilty of the following misconduct.

  • Failed properly disburse entrusted funds
  • Failed to cooperate with ethics investigators (Screw you, said Andre)
  • Engaged in conduct adversely on Andre’s honesty, trustworthiness, or fitness as a lawyer
  • Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation
  • Failed to reconcile his trust account
  • Failed to prepare quarterly reconcilaiton reports showing the balance appearing in the general ledger as of the reporting date
  • Failed to review, sign, date, and retain copies ofreconciliations of his attorney trust account for a period of six years
  • Failed to always identify on tiust account checks the client from whose balance checks from his trust account were drawn
  • Failed to maintain the minimum records required for general trust accounts
  • Failed to identify on all instructions, authorizations, and written or electronic records of transfers the client to whom the funds belong
  • Failed to maintain the minimum records required for general trust accounts
  • Failed to timely provide clients for whom he held entrusted funds with written accountings of the receipts and disbursements of all entrusted funds at the completion of all disbursements or at least annually if funds
  • were held for more than a year
  • Failed to render to his clients required accountings
  • Failed to deposit entrusted funds provided by credit card into a trust account
  • Failed to deposit, disburse and distribute cleint funds in accordance with the applicable rules
  • Failed to promptly pay or deliver to the client, or to third persons as directed by the client, any entrusted property belonging to the client and to which the client was currently entitled
  • Improperly used entrusted property for the benefit of himself or a third party

As a direct consequence of his misconduct the cheerleaders for Attorney Misfits sitting on the Grievance Committee of the North Carolina State Bar punished Andre by gifting him with a complimentary stayed 1-year suspension of his law license.

 

In truth, the comedians sitting on the North Carolina State didn’t mete out any meaningful punishment to Andre.

 

As we speak (ca. June 2023), Andre practices his so-called brand of law at 3013 Raeford Road in Fayetteville, North Carolina.
