Attorney Thomas Burns of Benton, AR; congenital liar

 
Panel B of the Arkansas Supreme Court Committee on Professional Conduct found Thomas guilty of the following misconduct
 
Thomas filed a complaint on his client’s behalf in Pulaski County Circuit Court after Martin Bowen appealed a court judgment against him in favor of Capitol City Tree Service. In response to Thomas’ complaint, Mr. Bowen filed a motion to dismiss because failed to comply with a court rule requiring him to serve a copy of the complaint within 30 days. The Circuit Court granted Mr. Bowen’s dismissal motion of Thomas’ complaint.
 
Shortly after the dismissal of his complaint, Thomas filed a notice of appeal. The Court of Appeals granted several extensions of time to Thomas to file his appellate brief. Mr. Bowen then filed a motion to dismiss the appeal. Thomas never filed a response; however he told the Court in writing that he didn’t file a brief because his client wished to dismiss the appeal.
 
As a result of Thomas’ conduct regarding the dismissal of his client’s appeal, the client was left with no opportunity to present his claim that Mr. Bowen owed him $4,125.
 
Subsequently, an ethics investigator contacted Thomas’ client, Charles Shaw about the appellate matter. Shaw stated he was not aware that Thomas had withdrawn his appeal.
 
Thomas’ Hyperbolic (BS) Defense
 
In his laughable defense to lying to the Appellate Court that his client wanted to dismiss his appeal, Thomas had the chutzpah to say he didn’t intend to mislead the court. How in the hell does one unintentionally put forth a bald faced lie to a court? Please Thomas, inquiring minds would like to know!
 
As a consequence of his misconduct, the cheerleaders for Attorney Misfits sitting on the Arkansas Supreme Court punished Thomas by gifting him with a complimentary caution. This is just another reason why most folks in Arkansas have total contempt for the manner in which Attorney Misfits are disciplined.
 
As we speak (ca. June 2012) Thomas practices law at 113 West Conway Street in Benton, Arkansas.
