The Bar of England and Wales provided David Edward Abberton with a law license in 1994 after he graduated from the University of Bristol School of Law.

The Bar Standards Board found Davey guilty of engaging in the following misconduct.

• Behaved in a way which was likely to diminish the trust and confidence which the public places in him or in the profession
• Drove a motor vehicle in a public place after consuming so much alcohol that the proportion of it on his breath, namely 80 micrograms of alcohol per 100 milliliters of breath, exceeded the prescribed limit of 35 micrograms of alcohol per 100 milliliters of breath
• Convicted of driving under the influence
• Ordered to pay a fine of £1,100.00
• Ordered to pay a victim surcharge of £111.00
• Disqualified from holding or obtaining a driving license for 3 years

As a direct consequence of his misconduct, the apologists for Barrister Misfits sitting on the Bar Standards Board punished Davey by gifting him with a complimentary reprimand and assessed investigative costs of £2,000.00.
