Attorney Samuel Mamich of Beachwood, OH; ethically inept

The state of Ohio presented Samuel Jay Mamich with a law license in 1973 after he graduated from Cleveland State University Law School.

Disciplinary Counsel of the Ohio Supreme Court found John guilty of the following misconduct.

Sam agreed to represent a client who had applied for and received a credit card in his daughter’s name; however, the daughter was unaware of what he did.

Subsequently, the credit card company sued the daughter to collect on the card’s balance of $1,040 plus interest of $381. Sammy then agreed to represent the daughter in the collection case; however, he didn’t have the courtesy to tell her he was acting as her attorney.

As the case proceeded, Sammy appeared at the default-judgment hearing and a case-management hearing on behalf of the daughter, filed an answer to the complaint and a response to the creditor’s motion for summary judgment. Sammy never notified the daughter nor did he receive any authorization from her to engage in any of these actions.

The trial court eventually entered a judgment in favor of the creditor and against the daughter. Sammy notified the father of the judgment but never told the daughter. The daughter first learned of the judgment when her wages were garnished. She then retained an attorney who successfully filed a motion to void the judgment and stay the garnishment after more than $1,000 had been garnished from her wages.

As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Ohio Supreme Court punished Sam by gifting him with a stayed six-month suspension of his law license. In truth, Sammy didn’t receive any real punishment for his misconduct.

As we speak (ca. June 2012) Sammy continues practices law with Zipkin Whiting Co. LPA at 3637 South Green Road in Beachwood, Ohio which is a suburb of Cleveland.
