Attorney Thomas Vivyan of Pataskala, OH; ethical leprechaun

The state of Ohio presented Thomas Fairchild Vivyan with a law license in 1971 after he graduated from Toledo University Law School.

The Lake County Bar Association Grievance Committee found Thomas guilty of the following misconduct.

Tom withdrew unearned fees of $1,535 from client trust account (cheater) and used them for his own personal use. Tommy engaged in this misconduct after settling a personal injury claim for $7,700 on behalf of three clients. He then distributed $910 to each of the three clients, which only represented 25% of the settlement proceeds.

Tom also agreed with his clients to negotiate a reduction of a medical bill, but also agreed to keep any remaining settlement proceeds in a client trust account while he negotiated with the doctor. Despite this agreement, Tom wrote eight (8) checks payable to cash to himself from the client trust account.

As a consequence of his misconduct, the patron saints for Attorney Misfits sitting on the Ohio Supreme Court punished Thomas by gifting him with a stayed six-month suspension of her law license. In truth, the comedians on the Supreme Court didn’t really punish Tommy for his misconduct.

As we speak (ca. June 2012) Thomas practices law at 17 Lookout Lane SW in Pataskala, Ohio which is a suburb of Columbus.
