Attorney Sam Thomas III of Cleveland; moron The state of Ohio presented Sam Thomas III with a law license in 1997 after he graduated from Cleveland State University Law School.
The Cleveland Metropolitan Bar Association Grievance Committee found Sam guilty of the following misconduct.
In a bankruptcy case, Sam took a fee that he was not lawfully entitled because he failed to obtain prior approval from the bankruptcy court and/or trustee. This conduct led to the trustee filing a motion with the court to order repayment of the fee to the trustee.
In another matter, Sam’s client refused to accept a settlement offer from an insurance company. When the court scheduled a hearing in the case Sam didn’t appear. Sam didn’t appear on the date of the trial either, thereby abandoning his client. As a result of his gross negligence, the trial court dismissed his client’s case. Sam then filed motions to reopen the case but they were denied by the court. Sam did not timely advise his client of the dismissal due to his negligence.
Luckily for the client, an attorney involved in the disciplinary matter told her she could re-file the lawsuit since the statute of limitations hadn’t tolled.
As a consequence of his misconduct, the enablers for Attorney Misfits sitting on the Ohio Supreme Court punished Sam by gifting him with a stayed six-month suspension of his law license. In truth, Sammy didn’t receive any real punishment for his misconduct.
As we speak (ca. June 2012) Sam continues to practice law at 614 West Superior Avenue in Cleveland.
