Attorney Gerald Dibble of Rochester, NY; serial perjurer

 

The state of New York provided Gerald W. Dibble a law license in 1972 after he graduated from the University of Maryland School of Law.

 

The Grievance Committee of the Seventh Judicial Department found Gerry guilty of engaging in the following misconduct.

  • Submitted to the Grievance Committee a written response wherein he made false or deceitful statements regarding material matters, including the false statement that the client had advised respondent that “there was no consent received” from the elderly relative regarding the transactions that gave rise to the APS investigation
  • Gerry’s written responses to the Grievance Committee contained self-serving and false or deceitful statements
  • regarding the elderly relative’s mental capacity to authorize the transactions in question
  • While testifying under oath to the Grievance Committee, Gerry made false statements (perjury) regarding the mental capacity of the elderly relative and falsely testified (perjury) that the client had told respondent that the client “stole” the funds belonging to the elderly relative or had taken the funds without the elderly relative’s authorization
  • Engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation
  • Engaged in conduct that is prejudicial to the administration of justice; and
  • Engaged in conduct that adversely reflects on his fitness as a lawyer
  • Misconduct involved an extended course of dishonest or deceitful conduct for personal gain that resulted in substantial harm or prejudice to a client
  • Made false statements during ethics investigation (Up yours, said Gerry!)
  • Misconduct involved an extended course of dishonest or deceitful conduct for personal gain
  • Misconduct resulted in substantial harm or prejudice to a client
  • Made misrepresentations or false statements to a client regarding the status of a legal matter
  • Engaged in dishonesty or deceit during the investigation of the Grievance Committee (Screw you, said Gerry!)
  • Lied to the client about the status of an Adult Protective Services (APS) investigation to induce the client to agree to certain revised retainer agreements that substantially increased the legal fee payable to respondent’s law firm or otherwise benefitted Gerry and his law firm

As a direct consequence of his misconduct, the enablers for Attorney Misfits sitting on the Fourth Judicial Department Disciplinary Board punished Gerry by gifting him with a complimentary 2-year suspension of his law license effective February 4, 2022.

 

And lastly, because Attorney Misfits in New York are held to a much lower standard of conduct then everyone else, Gerry was never criminally prosecuted for perjury.

 

As we speak (ca. June 2022), Gerry will resume his so-called practice of law in early 2024 with Dibble & Miller PC at 55 Canterbury Road in Rochester, New York.
