Judge John McBain of Jackson, MI; arrogant scofflaw

The state of Michigan presented John G. McBain with a law license in 1987 after he graduated from Thomas M. Cooley School of Law.

FYI: Johnny has had his significant snout firmly implanted in the public trough for the past thirty-three (33) years. Apparently, no self-respecting law firm in the greater Jackson County area was about to offer him a good paying job.

In one matter, the Court of Appeals overturned a sentence of 35 years in prison imposed by Johnny despite guidelines recommending a sentence of 20 years. During the sentencing hearing, Johnny told the defendant:

• "I hope you are haunted by the vision of you stabbing him (Greg Stack).”
• “After this day, you don't exist."
• “The one major flaw Stack had was that he stayed in a relationship with you.”

In reversing Johnny’s illegal sentencing of Dawn Dixon-Bey, the appellate court made the following findings.

• "If a trial judge is unable to follow the law as determined by a higher appellate court, the trial judge is in the wrong line of work.”
• ”Judge McBain’s decision to hand out a high sentence based on finding Dixon-Bey's crime as premeditated and deliberated, contrary to the jury's verdict, was an abuse of discretion and a willful violation of controlling precedent from our Supreme Court."

Johnny’s misconduct was reported to the Judicial Commission; however, it is highly unlikely the apologists on the Commission and the Michigan Supreme Court will take any action against Johnny for his blatant refusal to comply with the law.

As we speak (ca. May 2022), Johnny continues to dispense his so-called idea of jurisprudence as a 4^th Circuit Court Jackson County Judge in Jackson, Michigan.
