Attorney Mark Lackey of Shelby, NC; ethical troll

 

The state of North Carolina presented Mark D. Lackey with a law license in 1983 after he graduated from the University of North Carolina School of Law.

 

The Grievance Committee of the North Carolina State Bar found Mark guilty of engaging in the following misconduct.

  • Failed to prepare quarterly reconciliation reports showing the balance in his general ledger
  • Failed to review, sign, date and retain copies of reconciliations of his attorney trust account as required for six years
  • Failed to act with due diligence (slacker)
  • Engaged in a pattern of misconduct
  • Failed to timely pay title insurance premiums on behalf of his clients,
  • Failed to promptly pay or deliver to the client, or to third persons as directed by the client
  • Failed to provide information identifying the clients from whose balance wire transfer fees were drawn
  • Failed to maintain the minimum records required for general trust accounts
  • Failed to maintain a general ledger for his trust account
  • Failed to maintain the records necessary to conduct quarterly and monthly reconciliations of his trust account
  • Misconduct involved multiple offenses
  • Failed to exhibit remorse for his misconduct
  • Failed to take a required one-hour CLE course for attorneys with check signature or wire transfer authority over an attorney trust account before exercising check signature or wire transfer authority over his trust account

As a direct consequence of his misconduct, the apologists for Attorney Misfits sitting on the Grievance Committee punished Mark by gifting him with a complimentary stayed 2-year suspension of his law license.

 

In truth, the comedians sitting on the Grievance Committee didn’t mete out any meaningful punishment to Mark.

 

As we speak (ca. April 2022), Mark practices his so-called brand of law with Lackey & Lackey at 400 West Warrant Street in Shelby, North Carolina.
