The state of Colorado provided David Kenniston Fulton, Sr. with a law license in 2002 after he graduated from the University of Akron School of Law.

FYI: The University of Akron is ranked as the 147th best law school in the country out of 200 ABA (American Bar Association) accredited law schools.The Colorado State Bar found Davey guilty of engaging in the following misconduct.

• Davey provided over $75,000.00 to his clients in a series of transactions without first obtaining the clients’ written and informed consent to his role in the transactions
• Failed to advise his client whether he actually represented them in the $75,000 transactions, thereby creating conflicts of interest
• Deprived his clients of written advisements about the transactions and of opportunities to seek independent counsel
• Failed to communicate in writing the basis or rate of his fee and expenses before he began representing the clients
• Davey represented Mr. Gorst and his entity, Riviera Supper Club, Inc., in a deal to purchase a local piano bar and charged them $1,500.00 for his services
• In representing Gorst and the Supper Club, Davey did not provide a written statement to Mr. Gorst or to Riviera Supper Club setting forth the basis of his fee or his expenses before representing them in the transaction
• In representing Gorst and the Supper Club, Davey lent them $30,100 and used a deed of trust to secure the loan
• Davey failed to include anything in the loan agreement, the deed of trust that stated whether he was representing the Gorsts in the loan transaction
• Failed to provide the Gorsts with written fee agreement while representing them for both real estate and legal services
• related to locating and purchasing a new home
• Davey improperly entered into a business transaction with a client or knowingly acquired an ownership, possessory, security or other pecuniary interest adverse to his client
• Violated his duty of client loyalty to both the Gorsts and Riviera Supper Club by engaging in business transactions with them or on their behalf without appropriately notifying them of the potential conflicts of interests that could arise from his role in those transactions
• Violated his duty as a professional to provide the Gorsts and Riviera Supper Club with a written basis of his fee and expenses
• Acted knowingly and intentionally when he entered into the business transactions with his clients without fully complying with the applicable Colorado Rules of Professional conduct
• Davey knew that he had not regularly represented the Gorsts or Riviera Supper Club when he began
• counseling them in 2016 while never providing them with a required written basis or rate of his fee and expenses
• Davey harmed the Gorsts when he failed to advise them about possible conflicts of interest because he deprived them of adequate counsel— including advisements to have other lawyers review the transactions—and foreclosed their
• options to pursue other avenues
• Failed to provide full disclosures under Colo. RPC 1.8(a) to the Gorsts and Riviera Supper Club in five separate transactions with his clients

As a direct consequence of his misconduct, the enablers for Attorney Misfits in Colorado sitting on the Colorado Supreme Court punished Davey by gifting him with a complimentary stayed 6-month suspension of his law license.

In truth, the comedians sitting on the Colorado Supreme Court didn’t mete out any meaningful punishment to Davey.
