Retired Judge John Stewart of San Francisco; incompetent boob

The state of California provided John Stewart with a law license in 1980 after he graduated from Stanford University School of Law.

In one matter, Johnny was assigned to preside over a case wherein Plaintiff Acela Cortese alleged that her then attorney John Sherwood conspired with her late stepfather who was a multi-billionaire media tycoon, to deprive her of monies from her mother’s testamentary truest.

In his infinite ignorance, Johnny dismissed Ms. Cortese’s lawsuit by claiming it was barred by the California Code of Civil Procedure.

Subsequently, Ms. Cortese successfully appealed Johnny’s asinine ruling to Division One of the Fourth District Court of Appeal, which made ruled as follows.

• “Although her allegations are quite general, Cortese has sufficiently alleged that Sherwood breached his duty as her former attorney not to use her confidential information to her detriment.”
• “Assuming, as we must, the truth of Cortese’s allegations…, and in light of our obligation to construe her pleadings liberally..., Sherwood had a duty not to use information he learned about Cortese’s lack of financial sophistication or desperate financial circumstances in the course of assisting Robert in defrauding her by underfunding the trust and negotiating the trust termination agreement.”

Of course, it goes without saying that Johnny doesn’t much give a damn when he’s overturned (rebuked in truth) by the appellate court since he is well aware that no California judge has ever been tossed off the bench for being an incompetent boob. Moreover, he is confident that California Supreme Court Chief Justice Tani Cantil-Sakauye will not discontinue appointing him to sit on more cases despite evidence that he’s incompetent.

As we speak (ca. July 2021), Johnny continues to practice his so-called brand of jurisprudence as a San Francisco County Superior Court Judge in San Francisco.
